All photography delivered to Clients from New York Focus LLC carries the following copyright notification which is printed in plain view on the DVD or CD containing that photography and in plain view on this web site:

The unauthorized transfer of photography, a form of substantive and intellectual property, is considered a theft by law and is subject to sanctions and penalties under Title 17 of the United States code and the Copyright Royalty and Distribution Reform Act of 2004.

If said photography is transferred through e-mail or YouSendIt it is understood by the receiving party that the transferred photography is the sole property of New York Focus LLC and is protected from unlawful use and unlawful transfer by Title 17 of the United States code and the Copyright Royalty and Distribution Reform Act of 2004.

The general rule regarding any photography printed anywhere and in any ones possession is that a photo release in the form of a bill of sail specifically citing that photography or a contract of use from the lawful owner of that photography must be duly and lawfully obtained from said owner before any lawful use of said photography for commercial or even non commercial purposes.

The client's right of use becomes validated upon receipt of payment and constitutes a binding agreement between New York Focus and the above named client for the said job billed in the invoice for services. The rights of use are in turn defined by a formal Contract of Use naming the client, project and project specificts.

Rights Of Use: Photos may be used solely by the designated client for all marketing and advertising purposes as detailed below and may only be transferred to a third party when the said designated license holder is the sole recipient of gain from the use of the transferred photography. Such photography may not be transferred for the benefit of the named client if that transfer only indirectly benefits the designee of the right of use, but accrues wealth and potential business mainly for the recipient of that transfer alone. This includes business affiliates or partners, other architects, landscape architects, general contractors and subcontractors or associates that stand to accrue wealth in any way from the use of the designated photography.

Printed materials include books, magazines and company brochures catering to editorial content that benefits the holder of the right of use alone, the license holder's web site, ads, promotional publications, award submittals and trade shows.

New York Focus photographs are not transferable to third parties who may profit in any way from the use or possession of that photography. This would include individuals who unduly use said photography on in a web display, in brochures, presentations, press, award submittals or any other display for which those individuals are not authorized by sale or a prior written agreement.

Unlimited Usage Rights are granted to Client upon receipt of payment

The photography, defined in the aforementioned Contract of Use, may be delivered by DVD, CD by e-mail, ftp or YouSendIt. The bill for payment and contract of use may be enclosed or sent separately at the client's request.

All individuals considering the use of New York Focus photography for commercial purposes should be certain of their copyright authorization and aware of the stringent penalties for a violation of federal copyright statutes as described in Title 17 of the United States code and the Copyright Royalty and Distribution Reform Act of 2004
